Окремі особливості визначення органу державної влади як учасника цивільного судочинства

Abstract

Доповідь присвячена висвітленню окремих особливостей визначення органу державної влади як учасника цивільного судочинства. З цією метою: здійснено розмежування правосуб’єктності держави, органу державної влади, посадової особи при участі держави у цивільному судочинстві; обґрунтовано обмеженість принципу диспозитивності щодо участі органу державної влади у цивільному процесі. The report is devoted to the clarification of certain features of the definition of a public authority as a participant in civil justice. For this purpose: the division of the legal personality of the state, the state authority, an official with the participation of the state in civil legal proceedings has been carried out; justified limitations on the principle of discretion regarding the participation of a public authority in the civil process.
